Information Required in a Copyright Notice

For a notice intended to comply with 17 U.S.C. § 512(c)(3), please provide substantially all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
  2. Identification of the copyrighted work claimed to have been infringed. If one notice covers multiple works, provide a representative list.
  3. Identification of the material claimed to be infringing, together with enough information for us to locate it, preferably including the exact XpertXbox URL.
  4. Your name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

How We Handle Notices

We review sufficiently detailed copyright complaints and may remove or disable access to material when appropriate. We may contact the sender for missing information and may notify the person responsible for the affected material. The time required depends on the completeness and circumstances of the notice, so this policy does not promise a fixed response or removal time.

Counter-Notification

If material you provided was removed or disabled because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to info@xpertxbox.com.

A counter-notification intended to comply with 17 U.S.C. § 512(g)(3) should include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  4. Your name, address and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court, or, if your address is outside the United States, a judicial district in which XpertXbox may be found.
  6. A statement that you will accept service of process from the person who submitted the original notice or that person’s agent.

When applicable, we may forward a valid counter-notification to the original complaining party. Material may be restored within the period provided by applicable law unless we receive notice that the complaining party has filed a court action seeking to restrain the disputed activity.

Misrepresentations

Knowingly making a material misrepresentation that content is infringing, or that content was removed through mistake or misidentification, may result in liability under 17 U.S.C. § 512(f). Consider obtaining independent legal advice before submitting a notice or counter-notification.

Repeat Infringement

Where XpertXbox permits accounts or user-submitted material, we may restrict or terminate access for repeat infringers in appropriate circumstances.

Fair Use and Other Authorized Uses

Copyright exceptions—including fair use—depend on the facts of each situation. XpertXbox does not determine that every review, quotation, screenshot or commentary use is automatically lawful. A complaining party should consider whether the disputed use may be authorized by law before submitting a notice.
